CLIENT AGREEMENT

THIS AGREEMENT (the "Agreement") is dated at time of purchase with the payee, (the "Client") and the Phoebee Walpole of Walpole Ventures PTY LTD ABN: 45615369198 (the "Consultant")

By making this purchase you agree that you:

• Have read and agreed to all of the client policies listed
• Are 100% responsible for your own decisions and results.
• Authorise Phoebee Walpole to charge payments to the account details provided upon first payment as in line with the fee schedule / payment plan stated on this page.

Policies + Terms
Please read carefully.

Services

• Subject to the terms of this agreement, Phoebee Walpole must supply the Services to the Client in consideration of the Client paying the Fee to Phoebee Walpole.

• Phoebee Walpole will commence the provision of the Services within 30 days of the Commencement Date, and continue to supply it until this agreement is terminated pursuant to these terms.

• Except in 1-1 coaching, The Services may be supplied by such employees, contractors or agents that Phoebee Walpole may choose as most appropriate to carry out the supply.

• Except in 1-1 coaching, Phoebee Walpole reserves the right to change the inclusions and delivery format of the program at any time with the intention of providing the best outcomes to the client.

• Lifetime Access’ will be provided to the client as long as the program is running and for a minimum reasonable period of 3 years, or provided in a format the client can download to their own drives for long term use.

The Client must:

• Provide assistance to Phoebee Walpole as reasonably required so that Phoebee Walpole may competently perform its duties under this agreement

• Complete all necessary modules, tasks or homework and attend all scheduled programs to the best of their ability in the endeavour to reach the goals set between Phoebee Walpole & The Client.

• Make use of provided calls, resources and accesses during the contracted period. No inclusions can be held, carried over or used outside of the contracted period.

• Phoebee Walpole will attempt to obtain the Goals of the Client. The Client acknowledges that Phoebee Walpole makes no guarantee that the Goals can be achieved.

Fees:

This contract secures your place in the VIP Coaching or program directly with Phoebee Walpole. By signing this contract, The Client is agreeing to recognise that payments are non-refundable and by taking a place in this container, you are under contract to complete the entire duration of your payment plan. Therefore you cannot stop payments anytime. You are under contract to complete the entirety of the payment plan. The Client is responsible for any fees incurred by a Debt Collection agency.

• You agree to have funds available in your account for payment processing before the scheduled charge date. Failed or late payments will incur a fee of $20 USD / $30 AUD 

• This program has no cancellation policy. You are under contract to finish the entire payment plan even if you decide to not finish the program.

• Transfers are not available to any other course/programs of Phoebee Walpole.

Confidentiality

With respect to the Services, the Client must:

• Keep confidential all information, intellectual property and technical data disclosed by Phoebee Walpole to the Client

• Phoebee Walpole must not, without the prior written consent of the Client, use or disclose any documents in connection with the Services of this agreement, which is marked confidential by the Client related to the Services (“Confidential Information”), other than as necessary to provide and/or maintain the Services. The Client understands that Phoebee Walpole is allowed to share wins, results, testimonials and other information on Instagram, Facebook, Website, Email and other platforms with your private information being removed.

• Despite the above, either Party may disclose Confidential Information if and to the extent that such disclosure is required by law, or the information is generally available in the public domain except where that is a result of a disclosure in breach of this agreement.

Intellectual Property Ownership

The Client agrees that:

• You will not disclose or communicate information about Phoebee Walpole or participants practice, materials, fees or methods to other parties. 

• You will keep login information secure and agree not to share any intellectual property with unpaid third parties. Doing so may result in immediate termination from the program and all fees due immediately.

• You do not have authority to use any of the modalities or content provided to you by Phoebee Walpole in your own coaching services should you perform a similar job.

Rescheduling, Cancellations and Vacations:

• The Client agrees that calls may be rescheduled or cancelled by Phoebee Walpole from time to time.
  Clients rescheduling 1:1 calls must be done so with 24 hours notice. Phoebee Walpole cannot be responsible for rescheduling you in within 14 days and there may be a waiting period.

• Per 6 month period, Phoebee Walpole will take two (2) weeks of vacation leave during the program. This leave is inclusive of your contracted period. Any additional leave weeks will be credited as an extension to your contract period.
